TERMS & CONDITIONS

1. LIABILITY

1.1 KOMODO Image attempts to ensure that the information displayed on the website at any one time is true and accurate but cannot guarantee that it will be error-free. KOMODO Image does not make any warranty that the website is free from infection by viruses, trojans, worms or anything else that may adversely affect computer data.

2. TECHNICAL AND PRODUCTION DISCREPANCIES

2.1 KOMODO Image holds the right to have minor deviations as it relates to the descriptions found in its brochures, catalogues and any other written and electronic documents regarding the characteristics of the material, the colour, weight, measurements, manufacturing or similar properties as far as it reasonably can, match the expectations of the customer.

2.2 Business terms, conditions, services and products may be changed from time to time. KOMODO Image will post amendments and modifications on the website www.komodoimage.com . All purchases from the date of posting onwards will be governed by that new version.

3. CONTRACT

3.1 The customer's contract is with KOMODO Image, Unit F, Anahilt Business Park, 55A Glebe Road, Hillsborough BT26 6NG, Northern Ireland.

3.2 Every purchase made by the customer shall be deemed performed in Northern Ireland.

3.3 These Terms and Conditions shall be governed, construed and interpreted in accordance with the laws of Northern Ireland.

4. COPYRIGHT

4.1 It is impossible for KOMODO Image to check all designs created by customers to insure that no third-party rights are violated. KOMODO Image reserves the right to reject received orders already made if, in the course of the ordering process, KOMODO Image comes to find or suspect that printing the order would result in a violation of third-party rights. It is thus the responsibility of all customers to ensure they have the relevant permission from the legal owners before they request KOMODO Image to reproduce trademarks, logos, graphics and written works.

4.2 The customer will exempt KOMODO Image from all third-party action concerning violation of third party-rights at the instigation of the customer.

5. DELIVERY AND COSTS

5.1 Delivery and packaging charges are currently free for orders destined for Europe. Charges to other countries are clearly stated during the checkout process.

6. ORDERS AND CANCELLATION

6.1 If an order is accepted, KOMODO Image will send the customer an e-mail confirming the order.

6.2 KOMODO Image aims to dispatch all orders within 2 weeks of confirmation that an order has been accepted..

6.3 Customers have the right to cancel an order without a reason provided the cancellation is made within 24 hours, unless it can be shown that either KOMODO Image has already begun processing the order or incurred cost in the processing of the order.

7. RETURNS POLICY

7.1 As KOMODO Image products are personalised for each customer by customer instruction, KOMODO Image can only accept returns of products at the discretion of KOMODO Image Customer Services, provided that either the goods have been damaged in transit, or the goods suffer from a manufacturing defect.

MANUFACTURING DEFECT

In the event of a printing/manufacturing mistake made by KOMODO Image, customers will receive either a full refund or a replacement garment.

ERROR IN DESIGN

In the event of a spelling mistake/wrong design made by you, where manufacture of the garment has already commenced, KOMODO Image will be unable to offer a refund. KOMODO Image will, for a small fee, be able to amend the order and resend it. The fee will be at the companies discretion. If the customer alerts KOMODO Image to the mistake prior to manufacture then there will be no additional charge. (Please take time over creating your design to minimize any potential errors.)

SUBSTITUTE GARMENTS

From time to time garments are no longer available as described on the website. KOMODO Image reserves the right to substitute that garment with similar items which fall into the same garment category. It will be at the companies discretion whether it accepts returned items based on the slight variation of garment which the customer may receive.

DELIVERY TIMES

Please allow ample time for KOMODO Image to process and dispatch the order. There are sometimes elements beyond the companies control which could delay delivery. KOMODO Image cannot accept returns based on garments being no longer needed for a special occasion which has passed.

BULK ORDERS

If there is uncertainity about colours, size, cut/shape, printing method used for bulk orders then please order an initial sample to check. We are unable to offer refunds/replacement garments in the event that you simply “do not like” a product.

8. CUSTOMS

8.1 If the delivery address is outside the United Kingdom, the customer may be subject to import duties and/or taxes and associated charges.

8.2 KOMODO Image may supply a Customs Label containing a brief description, and a valuation of the parcel's contents.

9. DATA PROTECTION

9.1 KOMODO Image does not store any credit card information, nor pass any personal information, including credit or debit card information to any third party.

9.2 KOMODO Image will not pass on personal data to a third party unless the circulation has been agreed to previously in writing.

9.3 KOMODO Image will only disclose data to public agencies or other bodies if a legal obligation exists.

10. KOMODO Image uses “Worldpay” for online credit and debit clearing.

11. The customer undertakes that all details which are provided for the purpose of ordering goods are correct, that the credit or debit card has valid relevant ownership and that there are sufficient funds to cover the cost of the order.

12. KOMODO Image makes no representations about the fitness for a particular purpose of any of the products or services available on this website.

13. KOMODO Image does not accept liability for any indirect or consequential loss arising out of the use of the website or for any products or services purchased from the website.

14. KOMODO Image will only be liable for direct loss (save in the case of death or personal injury in respect of which there is no limit) up to a maximum total of the price of the product or service purchased in respect of any claim. This section applies only to the extent permitted by law.

15. MISCELLANEOUS

15.1 These terms and conditions contain the entire agreement between the customer and KOMODO Image relating to purchase. The customer is responsible for reading all information in these terms and conditions. If any of these terms are held to be invalid or unenforceable, those terms will be struck out and the other terms remain.
